Urgent WA Surrogacy Reform

Western Australians need your help to realise their dream of starting families. Many turn to surrogacy, only to discover that outdated laws hinder their chances of success, forcing them to seek overseas options or forsake their lifelong dream. By raising awareness and gaining political support, we can push through the much-needed surrogacy legislation. WIth elections happening, we need to act now. Together, we can make a difference!

As a concerned constituent, I write to you regarding an urgent issue affecting many Western Australians who aspire to have families. Both Premier Cook and the Hon. Amber-Jade Sanderson have acknowledged the need to reform WA's surrogacy laws which currently hinder Western Australians from having children locally. Despite WA Labor's promise in 2018 to implement revised legislation, no meaningful progress has been made.

These outdated laws force intended parents into costly and high-risk overseas surrogacy pathways, creating unnecessary challenges for children, surrogates, and parents.

As a political leader, I urge you to stand up, support your constituents, and advocate for the WA Government to deliver the necessary reforms to support Western Australian families.

Here are some of the key reasons why these reforms are desperately needed:

1. Australia's Domestic Surrogacy Framework is Inadequate.

The lack of accessible surrogacy options in Australia drives families overseas. In the last year, 420 children were born via surrogacy to Australian parents, with 300 births occurring overseas - most involving commercial arrangements that are illegal for Australians. These figures highlight the urgent need for a functional domestic surrogacy framework that assists Australians in having families locally. Our current framework is failing men and women in Western Australia.

2. Australian Children Born Via Commercial Surrogacy Are Not Adequately Protected Under Australian Law.

Australian children born through commercial surrogacy face significant legal challenges. Their parents are not legally recognised under Australian law, severely limiting the parents' ability to make medical decisions and creating obstacles for basic processes like obtaining passports. The government's unequal treatment discriminates against these Australian children and violates their fundamental rights.

3. WA Discriminates Against Men Seeking to Become Parents Through Altruistic Surrogacy.

Single men and gay men in Western Australia are discriminated against, and do not have access to altruistic surrogacy. This forces them to choose between giving up their dream of parenthood or leaving WA - an unacceptable choice. WA is the only state in Australia to force that decision on its male citizens and discriminate against Western Australian men.

WA's surrogacy laws are failing everyone. These laws actively discriminate against men and children, while forcing families to pursue inequitable and unsafe overseas options. The failure to act not only harms families but also violates the rights and welfare of children.

Doing nothing is no longer acceptable. It is time for WA to demonstrate leadership and compassion, particularly during an election year. I call on you to advocate for urgent surrogacy law reform supporting Western Australians in their fundamental desire to create families.
